Welcome to FLYXE. The terms "we", "us" and "our" refer to FLYXE. FLYXE operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). FLYXE is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

We have made every effort to provide an accurate representation of our products in our online store. However, colors or product appearance may differ from how they appear on your screen due to your device type and settings.
We do not warrant that the appearance or quality of any products purchased by you will meet your expectations or be the same as depicted in our online store.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region or jurisdiction.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. FLYXE reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until FLYXE confirms acceptance and payment has been processed.
Please review your order carefully before submitting, as FLYXE may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, change, or cancel an order, we will attempt to notify you via the email address provided at the time of the order.
Your purchases are subject to return or exchange solely in accordance with our Shipping & Returns.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
All prices on our website are displayed in Swedish Kronor (SEK) and are inclusive of Swedish VAT (moms) at the applicable rate (currently 25%), unless otherwise stated. For customers outside the EU, prices may be displayed excluding VAT depending on your location.
Prices are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, as confirmed in your order confirmation email.
Customs duties, import taxes, or other charges that may apply for orders shipped outside of Sweden are the sole responsibility of the customer. FLYXE is not responsible for any such additional costs.
You agree to provide current, complete and accurate payment and account information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are authorized to use the payment method, and (iii) charges incurred will be honored by your payment provider.
SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.
Once we transfer products to the carrier, risk of loss passes to you. For orders shipped outside of Sweden, the customer is responsible for any import duties, customs fees, or local taxes imposed by the destination country.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, images, graphics, product designs, video, and audio, are owned by FLYXE or its licensors and are protected by Swedish and international intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, or transmit any material from the Services without our prior written consent.
FLYXE's name, logo, product names, designs, and slogans are trademarks of FLYXE. You must not use such trademarks without our prior written permission. All rights not expressly granted herein are reserved by FLYXE.

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over. We provide access to such tools "as is" without any warranties or endorsement. We shall have no liability arising from your use of optional third-party tools.

The Services may contain links to third-party websites. We are not responsible for the content or accuracy of any third-party websites. FLYXE is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with FLYXE. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and FLYXE, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with FLYXE.

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our privacy policy. We may terminate this agreement or your access to the Services at any time without notice at our sole discretion. You will remain liable for all amounts due up to and including the date of termination. Sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law will survive any termination.
SECTION 16 - DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY STATED BY FLYXE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FLYXE AND ITS PARTNERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SECTION 18 - INDEMNIFICATION
You agree to indemnify and hold harmless FLYXE, Shopify, and our affiliates, officers, employees, and service providers from any losses, damages, or claims, including reasonable legal fees, arising out of (1) your breach of these Terms, (2) your violation of any law or third-party rights, or (3) your use of the Services.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision. These Terms, together with our Privacy Policy and any other policies posted on the Services, constitute the entire agreement between you and FLYXE regarding your use of the Services.

You may not transfer or assign these Terms or any of your rights without our prior written consent. We may transfer or assign these Terms without notice.
SECTION 22 - GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the Swedish courts, with Gothenburg District Court (Göteborgs tingsrätt) as the court of first instance. Consumer customers residing in the EU retain the right to bring proceedings before the courts of their country of residence where required by mandatory local law.
